New Details in Congressman Mahoney Divorce

There are new details in the messy divorce case of disgraced South Florida congressman, Tim Mahoney, and his wife. Paperwork filed a few days ago by Mahoney's estranged wife, Terry, list a number of allegations - including mental abuse.

Mahoney's wife claims her husband is living in Calgary Canada, staying in their condo with his girlfriend. She says the Congressman continues to "dissipate assets in furtherance of his extramarital affair." And the document says he did not deposit any funds for his wife on December 15 in a joint account like he's supposed to -- on the first and fifteenth of each month.

She claims quote: "The husband continues his lifestyle, while restricting the wife's access to marital funds." Mrs. Mahoney says not only is he not giving her any money, but he's taken two vacations since the divorce was filed.

Just three short months ago, in October, Congressman Mahoney expressed a desire to keep the marriage going.

"If I want my wife to love me and stay in this marriage, I've got to change, you know? If I don't then I'll lose the most important thing," said Mahoney.

However Terry Mahoney argues in the motion that the Congressman quote: "has been mentally abusing" her by filing pleadings suggesting a desire to reconcile, but continuing to see other women.

Back in October - the congressman also admitted to his wrong-doings.

"Well I've had multiple affairs and you know you do something like that, it's stupid," he had said.

His wife is asking for temporary alimony and exclusive use and possession day and night, of their home in a gated community in PGA National in Palm Beach Gardens. Currently, she is allowed to use the home during the day but not at night.

The motion, which was filed in court three days before Christmas, also says "based on the husband's behavior, the wife is fearful he will cancel her health insurance and auto insurance," and she's asking the court to require that Mahoney maintains all of her insurance policies during the divorce proceedings.

Tim Mahoney's lawyer has told CBS12, Mahoney is not dissipating their funds and would never leave his wife destitute. He calls the motion filed by the wife "overkill" and says it is just a bunch of excessive claims.

As for whether Mahoney is in Canada in the couple's condo with a girlfriend, he said he does not know where Mahoney is or whether he would let the wife have exclusive use of their house. He says the case is far from being resolved.
